Having just written a 30-page paper on the subject, I feel qualified to say that the above reading of the Convention Against Torture is mistaken. It is not a violation of the Convention to refuse to prosecute a war criminal -- it is, however, a violation of the Convention if the host country fails to prosecute AND resists extradition of said war criminal to a country that does intend to prosecute.

But yeah. International law is pretty damned hard to enforce, especially against the biggest kid on the block.

Fair enough. But who's going to even try to ask for extradition from the US? Seems like it's more of an escape clause when the harbouring country is the US.
