Can students sue York and CUPE 3903?

Interesting posts from Osgoode Law prof David Doorey here and here. Essentially, students would have no case against CUPE 3903 as they probably can't demonstrate they've suffered any loss as a result of CUPE 3903's actions. However, students might be able to argue that the University's delay of instruction does count as a loss -- the law appears unsettled on that point.
